1. Nature of the Ecosystem

BEYOND-YOU.NET LIMITED (the "Company") provides a technology platform (the "Ecosystem") that connects users with independent professionals.

IMPORTANT REGULATORY NOTICE: The Company is a technology service provider, not a medical or clinical entity. We do not provide medical advice, clinical diagnosis, or regulated healthcare services. All Specialists (Mental Health Supporters and Coaches) are independent contractors and are not employees of the Company.

2. Services Provided

The Ecosystem provides access to several categories of support. Users acknowledge that these services are facilitated by third-party Specialists:

  • Wellbeing & Specialist Sessions: Includes access to psychologists. These professionals are responsible for disclosing their own licensing and jurisdictional qualifications to the user. The Company does not verify clinical outcomes.
  • Coaching Services: Focused on personal development, career guidance, and resilience. The Company sets standards for Coach certification, but the professional relationship is strictly between the Coach and the User.
  • Yoga and Meditation: Training provided by qualified instructors. Participation is at the User’s own risk. The Company is not liable for physical injury or changes in mental health conditions resulting from these practices.
  • Future Innovations: The Ecosystem is evolving to include AI-powered wellness insights, proprietary hardware/gadgets, and data-driven personal development tools.

3. User Responsibilities

  • Eligibility: You must be at least 18 years old.
  • Medical Emergency: Our platform is not for emergencies. If you are in a crisis, you must contact local emergency services (e.g., 999 or 111 in the UK).
  • Account Integrity: You are responsible for maintaining the confidentiality of your login credentials for the Patient App.

4. Payment and Billing

4.1 For Users (Patients)

  • Booking: Users are charged at the time of booking.
  • Escrow-Style Payments: Payment is held by the Company and only released to the Mental Health Professional after both parties confirm the session has occurred, and no dispute is filed within 24 hours.
  • Pricing: The final price includes the Mental Health Professional's fee and the Company's platform margin.

4.2 For Service Providers (Therapists, Coaches, Teachers)

  • Subscription: Providers are billed immediately upon registering for a premium account on the Provider App.
  • Tiers: Pricing is set at $20 per month or $199 per year. Subscriptions renew automatically unless canceled.
  • Manager App: Clinics or organizations using the Manager App are subject to individually negotiated B2B contracts.

5. Cancellations and Refunds

All cancellations and refund requests are governed by our Refund & Cancellation Policy.

  • Cancellations with less than 24 hours' notice are non-refundable.
  • Technical failures on the platform's side are eligible for a full refund.

6. Privacy and Data Innovation

Your use of the Ecosystem is governed by our Privacy Policy.

  • Data Rights: You grant the Company the right to use anonymized data for the research and development of future technologies, including AI models and wellness hardware, subject to your opt-in consent.
  • Compliance: We operate in compliance with UK GDPR. While we are a UK entity, we apply high-level security standards (inspired by HIPAA and international frameworks) to protect your sensitive data.

7. Intellectual Property

  • Ownership: All software, algorithms, AI models, brand elements, and future hardware designs are the exclusive property of BEYOND-YOU.NET LIMITED.
  • License: Users are granted a limited, non-transferable license to use the Apps for personal, non-commercial wellbeing purposes.

8. Limitation of Liability

  • Platform Role: The Company is a facilitator. We are not liable for the conduct, advice, or quality of sessions provided by independent Specialists.
  • Damages: To the maximum extent permitted by UK law, the Company's total liability is limited to the amount paid by the user for the specific session or subscription month giving rise to the claim.

9. Insurance and Third-Party Reimbursement

The Company may provide tools to assist users in seeking reimbursement from insurance providers or NGOs. However:

  • No Guarantee: We do not guarantee that your insurance provider will cover the costs.
  • User Responsibility: Users are responsible for confirming eligibility with their respective insurers.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts in Greater London, United Kingdom.
